General Notes
Your data is collected, processed, and used by emploio GmbH (service provider within the meaning of the Telemedia Act and responsible entity within the meaning of the German Federal Data Protection Act and the EU General Data Protection Regulation).
This privacy policy applies to the use of all websites operated by emploio GmbH (hereinafter referred to as “emploio,” “we,” or “our”), including all subpages, content, and functions available there – both as a passive user (visitor without registration – passive data collection) and as an active user (visitor with registration – active data collection). Individual parts of emploio are also referred to as services, offerings, or online services.

“Personal data” means any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person (Art. 4 EU-GDPR).
The type and scope of personal data processed by emploio depend on the type of user and the extent to which the user makes use of emploio’s services.
Data is collected either passively (e.g., when visiting the website) or actively (e.g., when registering with emploio or logging into the customer portal).
Further information on the types of personal data, how this data is collected, and the legal basis for collection can be found in Section 6 (Passive Data Collection and Processing) and Section 7 (Active Data Collection) of this privacy policy.
When visiting a website operated by emploio, data is collected passively from visitors.
When you navigate through content or interact with content on our website, each time you access our site, usage data is transmitted by the respective internet browser and stored in log files, known as server log files.
The stored data records contain the following data: date and time of access, name of the accessed page, IP address, referrer URL (origin URL from which you came to the website), the amount of data transferred, product and information about the browser version used.
For technical reasons, and in particular for our own security purposes, IP addresses and log files are stored on our servers and are automatically deleted at regular intervals.
We create anonymous statistics to record the number of visitors to our websites (traffic) or for billing purposes to measure the number of clicks received from cooperation partners, but we do not create individual user profiles or link them to personally identifiable information.
User information about the emploio website is collected regarding user navigation on the emploio website in order to better understand the needs of our customers. Data collection is enabled through the use of cookies and tracking pixels. Cookies and tracking pixels do not harm your computer and do not contain viruses.
A cookie is a small text file that is stored on your computer by a website. This allows a user using that computer to be uniquely identified, and information about browsing behavior can be stored so that between two user sessions, previous actions of interest to the website can be retained. A cookie can be used to customize websites for the user.
You can disable the use and storage of cookies at any time via your browser settings, restrict them to certain websites, or set your browser to notify you when a cookie is about to be stored. You can also delete cookies at any time.
This allows passive data collection to be limited or blocked by the user.

Tracking pixels are also called web beacons or pixel tags. A tracking pixel is a graphic that is 1x1 pixels in size. With the help of a tracking pixel, user activities can be tracked.
The data generated in this way is used to improve emploio’s web offering, make it more user-friendly, and adapt services to the most frequently used browser types and versions.
When visiting the website, a direct connection is established to the servers of emploio’s partners (third-party providers) via tracking pixels, and information is transmitted to them. The transmitted information is not personal and emploio itself cannot link this information to individual user profiles or personally identifiable information.
If visitors to the website have set up a customer account or personal profile with one of our partners (third-party providers), it is possible for a third-party provider, e.g., Facebook, to link the information we transmit to a specific user.
Users can limit or object to this linking of their data by third-party providers with whom they are registered.
For users who wish to apply for a posted job advertisement via the website, or are in direct contact with an emploio recruiter (digitally or in person) – hereinafter referred to as “candidates” – it is necessary to express specific interest in a posted position or in future job offers.
If such an expression of interest occurs, candidates may be asked to provide further personal information.
These details are provided voluntarily by the candidate.
The personal data provided in the course of the recruitment process will be stored, processed, and used exclusively for the purpose for which the user has given consent.
Consent from candidates is given in conversation with our recruiters, recorded, and stored.
Persons who wish to apply via the emploio website, a personal conversation, or other means with one of our partners (“employers”) must give their consent in a pre-screening interview.
Upon giving consent, a candidate profile is created in which all application data is stored.

Applications are processed and forwarded by emploio on behalf of the employer under instruction. Employers may only use candidates’ personal data for the purpose of the application and not for any other purpose.

An applicant tracking system is a software solution used by some employers to make their recruitment and application process more effective and efficient. This includes managing and posting job ads, processing applications, inviting and rejecting candidates, or organizing interviews and trial days.
The emploio customer portal is an online platform where employers can view and process all applications for a posted position.
Candidate data and application documents are stored in the customer portal for the relevant position and can be accessed and used by the respective employer for the recruitment process.
Access to the customer portal is protected by technical and organizational measures. Employers can log in only via their own employer account and must grant access to applications exclusively to authorized personnel (e.g., recruiters, hiring managers, HR managers).
Candidate data is automatically deleted from the customer portal 6 months after the application date, in line with the principles of purpose limitation and data minimization.
Users and candidates have the right to obtain, upon request and free of charge, information about the personal data stored about them. They also have the right to correct inaccurate data, block data, and delete personal data, provided there is no statutory retention obligation.
Under Art. 21 GDPR, any user/candidate has the right to object at any time to the storage and processing of their personal data.
emploio acts as a data processor on behalf of the employer. Once an application has been forwarded to the employer (upon completion of the application process), emploio cannot reverse the process.
Deletion or correction of already submitted candidate data can only be carried out by the employer or upon their instruction to emploio.
Alternatively, candidates can contact emploio directly at info@emploio.de, and emploio will promptly forward the request to the responsible employer contact.
Registered users (“candidates”) may request deletion of their candidate account and all stored personal data at any time (Art. 15 GDPR).
To protect stored candidate data from unauthorized access, only requests sent from the same email address provided during registration will be processed.

Users/candidates can request information about stored data at any time by sending a simple email to info@emploio.de.
They may also request correction or completion of incomplete data (Art. 16 GDPR).
For security reasons, we may request additional information to confirm identity before processing such requests.
emploio is only responsible for personal data stored and processed within the candidate account at emploio. For all personal data forwarded to employers, candidates must contact the relevant employer directly.
To receive additional job offers and job profiles, candidates must actively opt in.
Opt-in consent is stored at emploio and remains valid until the candidate unsubscribes.
Candidates who opt in receive personalized job offers tailored to their profile, behavior, and preferences. These may be sent under the emploio brand or other brands of emploio GmbH.
Unsubscribing can be done via info@emploio.de or via the unsubscribe link in each email.
emploio has a service agreement with its partners under §611 BGB and acts as a processor within the meaning of Art. 4 GDPR.
The employer is responsible for ensuring active consent is obtained for all personal data provided to emploio (e.g., contact names, email addresses, employee photos).
Candidate data for a specific role may only be stored for up to 6 months after the position is filled. Employers are responsible for full deletion after this period.
We use Amazon Web Services for data hosting, with servers located in Frankfurt, Germany, and subject to EU data protection regulations.
